01About these terms

These Terms and Conditions form a binding agreement between you and Upkind CIC when you access or use the Upkind website, platform or any related service ("Upkind"). By using Upkind you accept these Terms.

If you are accessing Upkind on behalf of a school, charity or other organisation, you confirm you have the authority to bind that organisation to these Terms.

02About Upkind

Upkind is a youth development platform that helps young people record real world activities. This includes sport, study, volunteering, kindness and community involvement, then build into a personal development profile over time. The current version of the platform is in a pilot phase with a limited number of schools and partners.

Pilot status: Features may change, be added or removed without notice during the pilot phase. We will give pilot schools reasonable advance notice of material changes.

03Who can use Upkind

Upkind is designed for young people aged 8 to 21. Users under 13 must have verifiable parental or guardian consent. Schools, charities, partners and guardians may access Upkind in supporting roles.

You may not use Upkind if you are barred from doing so under the laws of your country, or if you have previously been removed for breaching these Terms.

04Accounts

  • You must provide accurate information when creating an account and keep it up to date.
  • You are responsible for the security of your login details and for activity that takes place under your account.
  • You may request deletion of your account at any time by contacting team@upkind.app.

05Acceptable use

Upkind is a positive space. You agree not to use Upkind to:

  • Misrepresent activities, contributions or identity
  • Bully, harass, intimidate or harm any person
  • Share content that is illegal, hateful, sexual, violent or harmful to minors
  • Attempt to interfere with the security, integrity or availability of the service
  • Use the platform for commercial promotion without our written agreement

Verifiers (teachers, coaches, guardians) agree to verify only activities they have genuine knowledge of.

06Content you record

You keep ownership of the activities, reflections and achievements you record on Upkind ("Your Content"). By recording Your Content on Upkind you grant Upkind CIC a limited, non-exclusive, royalty-free licence to host, store and display Your Content for the purpose of operating the platform and the features you have chosen to use (such as sharing a profile via QR code).

You may export or delete Your Content at any time.

07Pilot schools & partners

Pilot schools and partner organisations are governed by a separate pilot agreement, which sits alongside these Terms. In case of conflict, the pilot agreement takes precedence for matters specifically addressed in it.

08Privacy

Our handling of personal information is described in our Privacy Policy. By using Upkind you confirm you have read and understood that policy.

09Intellectual property

The Upkind name, logo, brand assets and platform are owned by Upkind CIC and protected by intellectual property laws. Nothing in these Terms transfers ownership of our intellectual property to you.

10Disclaimers

Upkind is currently in pilot and is provided "as is" without warranty of any kind, to the maximum extent permitted by law. We do not guarantee uninterrupted availability of the service or that records will be free of errors.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded under the laws of England and Wales, including for death or personal injury caused by negligence, or for fraud.

11Limitation of liability

To the extent permitted by law, Upkind CIC will not be liable for any indirect or consequential loss, loss of profit, loss of goodwill or loss of data arising out of or in connection with your use of Upkind.

For consumers in the United Kingdom, these Terms do not affect your statutory rights.

12Termination

You may stop using Upkind at any time. We may suspend or terminate access if we reasonably believe you have breached these Terms or pose a risk to other users or to safeguarding. Where possible we will give notice and an opportunity to resolve the issue.

13Changes

We may update these Terms as the platform develops. We will post the most recent revision date at the top of this page and notify pilot schools and account holders of material changes.

14Governing law & contact

These Terms are governed by the laws of England and Wales and disputes will be resolved by the courts of England and Wales.
